Terms of Service
These Terms of Service (the "Terms") govern your use of
PitManager — the web application available at
pitmanager.app for managing motorsport teams, vehicles, parts, maintenance
and race operations (the "Service"). The Service is
operated by [operator legal name], registered at
[registered address] ("we",
"us"). By creating an account or using the Service you
agree to these Terms on your own behalf and, where you act for a team or
company, on its behalf too.
1The Service
PitManager provides tools for race and workshop operations: fleet and
vehicle records, service-interval and wear tracking, job planning, tyre
and brake management, event calendars, live timing relays, incident
reporting (including photo and video storage), team member management with
roles and permissions, and related features. Features may be added,
changed or retired as the product evolves; we will not materially reduce
the core functionality of a paid plan during a period you have already
paid for.
2Accounts
- You must provide a valid email address and keep your credentials confidential. Actions taken through your account are attributed to you.
- You must be at least 16 years old, or the minimum age of digital consent in your country, to create an account.
- Notify us promptly if you believe your account has been compromised.
3Teams, roles and your data responsibilities
- A team's owner controls its membership, roles, billing and data. Members see and edit team data according to the roles and permissions the owner (or managers) assign.
- If you join a team, the team's owner decides what happens to team data — including data you entered — when memberships change or the team is deleted.
- You are responsible for having the right to upload the content you add (for example incident videos, photos, setup sheets and part documents) and for the accuracy of the data your team relies on.
4Subscriptions, billing and invoices
- Paid plans and optional add-ons (such as extra storage) are billed in advance on a recurring basis at the prices shown on the pricing page at the time of purchase. Prices are shown with applicable VAT where required.
- Payments are processed by Mollie; we do not store your full payment details. Invoices are issued electronically to your billing email.
- Subscriptions renew automatically until cancelled. You can cancel at any time from the billing settings; cancellation takes effect at the end of the paid period, and no partial-period refunds are given unless required by law.
- If a renewal payment fails and is not resolved after our reminders, we may downgrade or suspend the subscription.
- We may change prices with at least 30 days' notice; changes apply from your next renewal.
- If you are a consumer in the EU, you consent to the Service starting immediately and acknowledge that the statutory 14-day withdrawal right lapses for the period already delivered.
5Your content
- Your team's data remains yours. We claim no ownership over vehicle records, setups, timing data, media or documents you upload.
- You grant us the limited licence needed to operate the Service: to host, store, process, back up, transmit and display your content to the people you have shared it with (your team members, and anyone you give a public share link to).
- Public share links (for example incident reports or run sheets) make the linked content readable by anyone who has the link. You control creating and revoking these links.
6Acceptable use
You must not:
- upload content that is unlawful, infringes third-party rights, or contains malware;
- probe, breach or circumvent authentication, rate limits or team isolation, or access data of teams you are not a member of;
- resell or re-provide the Service to third parties as your own offering without our written agreement;
- use automated bulk scraping of the Service, or place unreasonable load on it beyond normal application use;
- use the Service to send spam or operate a live-timing rebroadcast in breach of the timing provider's terms.
7Safety disclaimer — race data is informational
PitManager helps you organise maintenance and race data, but it is
not a safety device and not a substitute for professional
judgment. Wear estimates, service intervals, brake and tyre
tracking, live timing and similar outputs are informational aids based on
the data your team enters. Physical inspection by qualified personnel and
compliance with the applicable sporting and technical regulations remain
your responsibility. Never rely solely on the Service for decisions
affecting the safety of drivers, crew or spectators.
8Availability and support
- We aim for high availability but the Service is provided without an uptime guarantee. Maintenance, third-party outages (hosting, timing feeds, payment or email providers) or force majeure may cause interruptions.
- Support is provided through the in-app support channel on a reasonable-efforts basis.
- We recommend exporting data you consider critical before race weekends; the Service's availability during an event is not guaranteed.
9Data protection, retention and deletion
- How we handle personal data is described in the Privacy Policy.
- After a subscription is cancelled or a team is deleted, team data enters a grace period of 90 days during which the owner can reactivate and recover it. After the grace period the data — including uploaded media — is permanently purged and cannot be restored.
- We retain invoices and records we are legally required to keep for the statutory retention periods, independent of account deletion.
10Intellectual property
The Service, its software, design and branding are our intellectual
property or that of our licensors. These Terms give you a limited,
non-exclusive, non-transferable right to use the Service for your team's
internal operations while your account is in good standing.
11Liability
- Nothing in these Terms excludes liability that cannot be excluded by law (including for intent or gross negligence, or death or personal injury caused by our negligence).
- Otherwise, our total aggregate liability arising out of or related to the Service is limited to the amounts you paid us for the Service in the 12 months preceding the event giving rise to the claim.
- We are not liable for indirect or consequential damages, loss of profits, loss of data you failed to keep reasonable copies of, missed race results, penalties, or decisions made in reliance on informational outputs (see section 7).
12Suspension and termination
- You may stop using the Service and delete your account at any time from account settings.
- We may suspend or terminate access with immediate effect for serious or repeated breach of these Terms, unlawful use, non-payment, or where required by law. Where reasonable, we will warn you first and give you an opportunity to remedy the issue.
- Sections that by their nature survive termination (including 5, 9, 10, 11 and 14) continue to apply.
13Changes to these Terms
We may update these Terms as the Service evolves. For material changes we
will notify you in the app or by email and ask you to accept the new
version; the version and effective date are shown at the top of this page.
If you do not agree to a material change you may cancel before it takes
effect.
14Governing law and disputes
These Terms are governed by Belgian law. Disputes are
subject to the exclusive jurisdiction of the competent courts of the
operator's registered seat in Belgium, without prejudice to mandatory
consumer protections of your country of residence if you are a consumer.
